Welcome to BNDNA Club.

These Terms of Service govern your use of the BNDNA Club website, online store, products, features and related services (collectively, the “Services”).

Throughout these Terms, “BNDNA Club,” “we,” “us” and “our” refer to BNDNA Club.

By accessing our website, using the Services, placing an order, creating an account or otherwise purchasing from us, you agree to these Terms of Service together with our Privacy Policy, Returns & Refund Policy and any other policies made available through our website.

If you do not agree to these Terms, you should not use the Services.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot legally be excluded, restricted or modified, including rights available under the Australian Consumer Law.

1. Our Online Store

Our online store is hosted using Shopify.

Shopify provides the ecommerce platform that allows us to offer and sell our products to you.

Although Shopify provides the technology used to operate the store, purchases made from BNDNA Club are transactions between you and BNDNA Club, unless otherwise stated.

Shopify similarly states that transactions between merchants and customers remain the merchant's responsibility.

2. Eligibility to Use the Services

By using the Services, you confirm that:

  • You are legally capable of entering into the transaction you are making; or
  • Where required, you have permission from a parent, guardian or other person legally authorised to act for you.

You must not use our Services for any unlawful or unauthorised purpose.

You must also comply with applicable laws when using our website or purchasing our products.

3. Product Information

We try to make product descriptions, photographs, measurements, sizing information, colours, materials and other product information as accurate as reasonably possible.

However, there may be minor differences between how a product appears online and how it appears in person.

For example:

  • Colours may appear differently depending on your screen or device.
  • Measurements may have reasonable manufacturing tolerances.
  • Placement of printed or embroidered designs may vary slightly between individual garments.
  • Minor variations may occur between production batches.

These reasonable variations do not affect any rights you may have where a product genuinely fails to meet a consumer guarantee.

If there is a significant error in a product listing, we may correct it as soon as reasonably possible.

4. Sizing

Customers are responsible for reviewing the product description and available size guide before ordering.

Sizing may vary between different garments or styles.

If you order an incorrect size, you may be able to request a return under our Returns & Refund Policy, provided the item meets the eligibility requirements of that policy.

Your legal rights regarding faulty, incorrect or misdescribed products are separate from ordinary sizing or change-of-mind returns.

5. Prices

All prices displayed on our website are shown in the currency indicated at checkout.

Prices may change from time to time.

Changing the price of a product does not affect an order that we have already accepted, except where there has been an obvious pricing or technical error and applicable law allows us to correct it.

Any applicable:

  • Taxes
  • Duties
  • Fees

will be displayed or calculated where applicable during checkout.

6. Promotions, Discounts and Discount Codes

We may offer:

Unless otherwise stated:

  • Discount codes cannot be exchanged for cash.
  • Discounts may not be combined with other offers.
  • A promotion may be limited to certain products, customers, regions or periods.
  • Minimum purchase requirements may apply.
  • Promotional offers may end when the stated period ends or when allocated promotional stock is exhausted.

We may refuse or cancel the use of a promotional code where it has been obtained, distributed or used fraudulently or contrary to the conditions of that promotion.

Any restriction will be applied subject to applicable consumer law.

7. Orders

Submitting an order does not necessarily mean we have accepted it.

After you place an order, you may receive an automated confirmation showing that the order has been received.

We may review an order before accepting and processing it.

We may decline or cancel an order where reasonably necessary, including where:

  • Payment cannot be authorised.
  • There is suspected fraud.
  • A product is unavailable.
  • There is an obvious pricing or listing error.
  • Shipping to the supplied destination is unavailable.
  • The order breaches these Terms.
  • We are required to do so by law.

If we cancel an order after payment has been successfully received and you are entitled to a refund, we will arrange the appropriate refund.

8. Order Limits and Limited Stock

Some products may be released in limited quantities.

We may place reasonable limits on:

  • The number of products available
  • The number of products a customer may purchase
  • Particular sizes or colours
  • Limited releases
  • Promotional products

Stock numbers displayed on our website may change as purchases are completed.

Placing an item in your shopping cart does not reserve that product.

An item is not secured until checkout has been completed and the order has been accepted.

9. Payments

You agree to provide current, complete and accurate payment and billing information when making a purchase.

Payments may be processed using Shopify Payments or other third-party payment providers available at checkout.

Payment options may change from time to time.

Your use of a third-party payment service may also be subject to that provider's own terms and privacy policy.

Shopify maintains separate terms for merchants using its payment services.

10. Fraud Prevention

We may use automated or manual fraud-prevention measures to protect customers and our business.

If an order appears suspicious, we may:

  • Request additional verification.
  • Delay processing while the order is reviewed.
  • Refuse or cancel the transaction where reasonably necessary.
  • Report suspected unlawful conduct where required or permitted by law.

We will not intentionally refuse legitimate orders for discriminatory reasons prohibited by law.

11. Manufacturing and Fulfilment

Some products may be produced, packaged or fulfilled by third-party manufacturers, production partners or fulfilment providers on our behalf.

To fulfil an order, relevant information may be provided to these providers, such as:

  • Your name
  • Shipping address
  • Contact details
  • Ordered products
  • Other information reasonably necessary to manufacture or deliver the order

12. Shipping and Delivery

Shipping times shown on our website are estimates unless expressly stated otherwise.

Delivery can be affected by circumstances outside our reasonable control, including:

  • Courier delays
  • Customs processing
  • Weather
  • Public holidays
  • High order volumes
  • Incorrect addresses
  • International transport disruption
  • Other logistical delays

We will take reasonable steps to fulfil orders within the timeframe communicated to you.

Where Australian Consumer Law applies, services must be supplied within the agreed timeframe or, where no timeframe is agreed, within a reasonable time.

13. Shipping Information Provided by Customers

You are responsible for checking that the shipping details submitted at checkout are accurate.

This includes:

  • Recipient name
  • Street address
  • Unit or apartment number
  • Suburb
  • State
  • Postcode
  • Country
  • Contact information

If you notice an error after ordering, contact us as quickly as possible.

We may be unable to modify an address after an order enters production or shipping.

Where permitted by law, additional costs resulting from incorrect shipping information supplied by the customer may be the customer's responsibility.

14. International Orders

Where international shipping is available, customers may be responsible for:

  • Customs duties
  • Import taxes
  • Brokerage charges
  • Other charges imposed by their country

unless we specifically state that those charges are included.

Customs requirements vary between countries and may change.

Customers are responsible for ensuring that products they order can legally be imported into their destination country.

15. Returns, Refunds and Exchanges

Returns, refunds and exchanges are governed by our separate Returns & Refund Policy.

Our current policy includes a 14-day change-of-mind return period starting from delivery, subject to its eligibility requirements.

Customers are responsible for return shipping costs for ordinary eligible change-of-mind, sizing or preference returns.

Customers should not send any product back without contacting us first.

Once a return is approved, we will provide the correct return instructions and return address.

These voluntary return conditions do not remove rights available under Australian Consumer Law.

The ACCC confirms that a business cannot use store terms such as a fixed refund period to take away statutory consumer guarantees.

16. Faulty, Damaged or Incorrect Products

If you receive a product that is:

  • Faulty
  • Damaged
  • Defective
  • Incorrect
  • Significantly different from its description
  • Otherwise potentially in breach of a consumer guarantee

please contact us as soon as reasonably possible.

We may ask you for reasonable information such as:

  • Your order number
  • Photographs
  • Videos
  • A description of the problem

We may also need to review the matter with our manufacturer or fulfilment provider.

Where Australian Consumer Law applies, you may be entitled to a repair, replacement, refund, compensation or another remedy depending on the circumstances and seriousness of the failure.

17. Australian Consumer Law

Our goods come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Among other things, products supplied to consumers must meet applicable requirements relating to:

  • Acceptable quality
  • Fitness for stated purposes
  • Matching descriptions
  • Matching samples or demonstration models where relevant
  • Other applicable consumer guarantees

Nothing in these Terms is intended to exclude, restrict or modify those guarantees or any remedies that cannot legally be excluded.

If any wording in these Terms conflicts with a mandatory right under Australian Consumer Law, the mandatory legal right will prevail.

18. Change of Mind

Australian Consumer Law does not generally require a business to provide a refund solely because a customer:

  • Changed their mind
  • Ordered the wrong size
  • Found the item cheaper elsewhere
  • No longer wants the product

However, BNDNA Club voluntarily provides certain change-of-mind returns according to our Returns & Refund Policy.

The requirements of that policy must be met for a voluntary change-of-mind return to be accepted.

19. Order Changes and Cancellations

Orders may begin processing or production shortly after they are submitted.

If you want to change or cancel an order, contact us as soon as possible.

We may be able to assist before production or fulfilment begins, but we cannot guarantee that an order can be changed or cancelled once processing has started.

Nothing in this section removes any rights or remedies you may have under applicable law.

20. Intellectual Property

Unless otherwise stated, the content made available through BNDNA Club is owned by or licensed to BNDNA Club.

This may include:

  • Brand names
  • Logos
  • Clothing designs
  • Graphics
  • Artwork
  • Product photography
  • Videos
  • Website designs
  • Text
  • Product descriptions
  • Layouts
  • Digital content
  • Other creative material

Our content may be protected by copyright, trade mark and other intellectual property laws.

You must not, without permission and where prohibited by law:

  • Copy our designs for commercial use.
  • Reproduce our artwork.
  • Sell counterfeit products using our branding.
  • Use our logo or branding in a way that suggests an unauthorised association with BNDNA Club.
  • Republish substantial portions of our website for commercial purposes.
  • Remove intellectual property notices.

Nothing in these Terms transfers ownership of BNDNA Club intellectual property to you.

21. Customer Content

If we allow customers to submit:

  • Reviews
  • Comments
  • Photos
  • Videos
  • Testimonials
  • Social-media content
  • Other material

you confirm that you have the right to provide that content.

You must not submit content that:

  • Infringes another person's intellectual property.
  • Is unlawful.
  • Is fraudulent or misleading.
  • Contains malicious software.
  • Contains another person's private information without permission.
  • Is abusive or threatening.
  • Otherwise violates applicable law.

Where you knowingly submit content to us for publication or promotional use, you grant BNDNA Club a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and communicate that content for purposes reasonably connected with our store, marketing and Services, unless otherwise agreed.

This does not transfer ownership of your content to us.

22. Reviews

Reviews must reflect genuine experiences and must not intentionally mislead other customers.

We may moderate or remove reviews where reasonably necessary, including reviews that contain:

  • Spam
  • Fraudulent content
  • Personal information
  • Abusive material
  • Unlawful content
  • Content unrelated to the product
  • Malicious links

We will not manipulate reviews to create a misleading impression of customer opinion.

The ACCC states that rules against misleading conduct also apply to online product reviews.

23. Acceptable Use of Our Website

You must not use our website or Services to:

  • Commit fraud
  • Break applicable laws
  • Infringe intellectual property rights
  • Distribute malware or viruses
  • Attempt to gain unauthorised access to our systems
  • Scrape the website in a way prohibited by law or our technical protections
  • Interfere with website security

  • Submit false information
  • Impersonate another person
  • Use automated systems to manipulate purchases, stock or promotions
  • Attempt to circumvent purchase limits

We may restrict access to the Services where reasonably necessary to protect our customers, systems or business.

  • Events outside our reasonable control

We may modify or discontinue website features from time to time.

Nothing in this section excludes rights that cannot lawfully be excluded.

26. Errors and Inaccuracies

We may correct genuine errors when discovered.

Nothing in these Terms excludes, restricts or modifies liability where doing so would be prohibited by law, including liability arising under Australian Consumer Law.

To the maximum extent permitted by law, BNDNA Club will not be responsible for losses that:

  • Were not reasonably foreseeable
  • Were not caused by our breach
  • Result from misuse of our website or products
  • Result from circumstances outside our reasonable control

Any limitation in these Terms applies only to the extent legally permitted.

28. Indemnity

To the extent permitted by law, you may be responsible for reasonable losses suffered by BNDNA Club arising directly from your unlawful use of the Services or your material breach of these Terms.

This section does not require you to compensate us for losses:

  • Caused by BNDNA Club
  • Not reasonably connected with your conduct
  • That cannot legally be passed on to you

I’ve intentionally kept this clause relatively narrow. Australian law prohibits unfair terms in standard-form consumer contracts, and potentially unfair terms can attract penalties.

29. Privacy

Our handling of personal information is governed by our Privacy Policy.

Our Privacy Policy explains:

30. Changes to These Terms

We may update these Terms from time to time for reasons such as:

Updated Terms will be published on our website with a revised Last updated date.

Changes will not remove rights relating to completed purchases where doing so would be prohibited by law.

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where permitted.

The remaining provisions will continue to apply to the extent legally possible.

32. No Waiver

If we do not immediately enforce a provision of these Terms, that does not necessarily mean that we permanently give up the right to enforce it later.

33. Entire Agreement

These Terms, together with policies expressly incorporated into them, including our:

  • Returns & Refund Policy
  • Any other applicable store policies

form the agreement between you and BNDNA Club regarding use of our Services and purchases from our store, subject to rights that cannot legally be excluded.

34. Governing Law

These Terms are governed by the laws applicable in Western Australia, Australia, together with applicable Commonwealth laws including the Australian Consumer Law.

Nothing in this section prevents a consumer from relying on any mandatory rights or legal protections available to them under applicable law.
